Remote Appearances in Ada County DUI Cases: When You Must Show Up in Person and When Webex/Zoom Works

Getting a DUI in Boise disrupts everything—work, family, and your calendar. One of the most common questions we hear is: “Do I have to go to every court date in person?” Idaho's rules do allow remote appearances in many situations, but there are key moments when your physical presence is required. Here's the Ada County-specific roadmap so you don't miss a required hearing or a chance to advance your defense.

What the Idaho rules actually say

Idaho Criminal Rule 43 lists the hearings where a defendant must be present: arraignment, the time of plea, every stage of trial, including the verdict, and sentencing. The rule states the defendant “must be present” at those proceedings.

There are important exceptions. Rule 43(b) can allow misdemeanor defendants to proceed without being physically present if they are represented by counsel or have given written consent for arraignment, plea, trial, or sentencing. In other words, for many misdemeanor DUI settings, we can often appear for you or arrange a remote appearance—subject to the judge's approval and local practice.

Idaho also has a companion rule, I.C.R. 43.1, which expressly authorizes phone or video appearances “in the discretion of the judge” for first or subsequent appearances, bail hearings, and misdemeanor arraignments and pleas (among others), so long as the judge and defendant can see/hear each other and the court records the proceeding.

Finally, Idaho Code confirms a long-standing misdemeanor principle: “For the purpose of judgment, if the conviction is for a felony, the defendant must be personally present; if for a misdemeanor, judgment may be pronounced in his absence.” That's Idaho Code § 19-2503. Some judges will still prefer in-person sentencing, but the statute allows room, especially with counsel present.

How this plays out in Ada County

Most misdemeanor DUI cases in Boise, Meridian, Eagle, Garden City, Kuna, and Star are set in the Ada County Magistrate Court at the downtown courthouse. The county publishes public calendars and provides Webex/Zoom instructions for remote participation. Those are your official sources for dates and connection details.

Typical pattern we see:

  • First appearance / arraignment: Judges commonly allow in-person or video per I.C.R. 43.1. We'll confirm your judge's preference and handle the logistics.

  • Status / pretrial conferences: Frequently handled by counsel without you if you do not live in state, or by video if the court requires your participation. (Covered by I.C.R. 43(b) for misdemeanors.)

  • Motion hearings / evidentiary issues: Many are conducted in person; some judges allow video testimony or appearances depending on the witness and the issue. We'll coordinate based on the notice and your judge's practice.

  • Change of plea & sentencing: Legally can be done by video or in your absence for misdemeanors, but practices vary. We'll discuss the optics: sometimes being present helps; sometimes video is fine.

Why presence vs. remote matters to your defense

Two things can happen when appearances go sideways: (1) the court can issue a warrant if you miss a required hearing, and (2) you can lose leverage with the judge. We want you present—physically or virtually—when it helps your case. For example, at bail-modification or compliance hearings, appearing (even by video) lets us demonstrate treatment progress, negative tests, or steady employment, which can unlock better conditions moving forward.   • Find your hearing and link: Use the Ada County Court Calendar tool. It includes appearance instructions and courthouse contacts if you need help connecting.

  • Webex/Zoom how-to: The county posts video instructions and contact info for assistance (Trial Court Administrator, Clerk's Office). Save these pages and numbers in your phone.

Checklist to make sure you show up the right way:

  • Check the official calendar the day before and morning of your hearing to confirm time and connection info.

  • Ask us whether you must attend or if we can cover for you under I.C.R. 43(b). If you need to be there, we'll confirm whether video is acceptable under I.C.R. 43.1. 

  • If remote: test audio/video, sit somewhere quiet, name your screen with your legal name, and join early so the clerk can check you in.

A note on what the rules don't do

Rules 43 and 43.1 open the door to remote or counsel-only appearances, but they don't guarantee them. The judge retains discretion, and individual courtrooms may adhere to practices shaped by docket size, witness needs, or tech issues. We'll make the request in the way most likely to be granted and preserve your leverage with the court.
